Welcome to Bizlify ("we," "our," or "us"). These Terms and Conditions govern your access to and use of the Bizlify platform, website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
"User," "you," and "your" refer to the person or entity accessing or using the Services.
"Restaurant Partner" refers to any restaurant or food establishment that uses our platform to create and manage their branded food ordering application.
"End Customer" refers to any individual who uses the restaurant's branded application powered by Bizlify to place orders and interact with the Restaurant Partner.
To use certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
As a Restaurant Partner, you are responsible for:
Our Services are offered on a subscription basis. You agree to pay all fees in accordance with the pricing and payment terms presented to you. Subscription fees are billed in advance on an annual basis.
You authorize us to charge your designated payment method for these fees. If your payment cannot be completed, we may suspend or terminate your access to our Services.
In addition to the subscription fee, Bizlify charges a commission on each transaction processed through your branded application. The commission rate depends on your subscription plan and is clearly specified in your service agreement.
Commission fees are automatically deducted from the payments processed through your application, and the remaining amount is transferred to your designated bank account.
Bizlify owns all rights, title, and interest in and to the Services, including all intellectual property rights. You may not copy, modify, distribute, sell, or lease any part of our Services without our express written permission.
Restaurant Partners retain ownership of their restaurant name, logo, menu items, and other brand assets provided to us for use in their branded application.
Restaurant Partners own all customer data collected through their branded application. Bizlify processes this data on your behalf and in accordance with our Privacy Policy.
You agree to use this data in compliance with all applicable privacy laws and regulations.
We may terminate or suspend your access to our Services immediately, without prior notice or liability, if you breach these Terms.
As a Restaurant Partner, you may terminate your subscription in accordance with the cancellation terms specified in your service agreement. Upon termination, you will lose access to your branded application and associated services.
To the maximum extent permitted by law, in no event shall Bizlify be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.
You agree to defend, indemnify, and hold harmless Bizlify and its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.
We reserve the right to modify these Terms at any time. We will provide reasonable notice of any material changes. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
